REGULATION OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE

CONCERNING
IMPORT CUSTOMS NOTIFICATION
DIRECTOR GENERAL OF CUSTOMS AND EXCISE,
Considering:
- a. that to meet the obligation to submit and standardize import customs notification, the model, content, and detailed element of import customs notification and guide to fill it need to be stipulated;
- b. that in consideration of the matter in letter a and in an effort to implement provisions in Article 11 of Regulation of the Finance Minister No 155/PMK.04/2008 concerning Customs Notification, it is necessary to stipulate Regulation of the Director General of Customs and Excise concerning Import Customs Notification;
In view of:
- 1. Law No. 10 of 1995 concerning Customs (Statute Book No. 75 of 1995, Supplement to Statute Book No. 3612) that is amended by Law No. 17 of 2006 (Statute Book of 2006 No. 93, Supplement to Statute Book No. 4661);
- 2. Law No. 11 of 1995 concerning Excise (Statute Book No. 76 of 1995, Supplement to Statute Book No. 3613) that is amended by Law No. 39/2007 (Statute Book of 2007 No. 105, Supplement to Statute Book No. 4755);
- 3. Regulation of the Finance Minister No. 100/PMK.01/2008 concerning the Organizational Structure and Work Mechanism of the Finance Ministry as has been amended by Regulation of the Finance Minister No. 149/PMK.01/2008;
- 4. Regulation of the Finance Minister No. 155/PMK.04/2008 concerning Customs Notification;
HAS DECIDED:

REGULATION OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE CONCERNING IMPORT CUSTOMS NOTIFICATION
CHAPTER I
GENERAL PROVISIONS
Article 1
In this Regulation:
- 1. Customs Law is Law No. 10 of 1995 concerning Customs that is amended by Law No. 17 of 2006 concerning Amendment to Law No. 10 of 1995 concerning Customs.
- 2. Import customs notification is a statement made by an individual to meet import customs obligation in the form and under the terms set by the Customs Law.
- 3. Electronic data are a piece of information or a series of information designed and/or gathered for special use, received, recorded, sent, stored, processed, re-accessed, or produced electronically using an electronic or optical data processing computer or instrument or other similar means.
- 4. Customs Electronic Data Exchange, hereinafter referred to as customs PDE, is a process of submitting customs documents in the form of electronic data exchange through communication among applications and among organizations integrated using a data communication system.
- 5. Individual is either an individual or corporate body.
- 6. Bonded hoarding place is a' building, place or area that meets certain terms to pile up goods for certain purposes by obtaining deferred import duty facility.
- 7. Customs office is the office at the Directorate General of Customs and Excise where customs obligations are met in accordance with the Customs Law.
Article 2
Import customs notifications shall consist of:
- a. notification on the import of goods;
- b. notification on the import of special goods;
- c. notification on the personal articles of passengers and crew members of transport means (customs declaration);
- d. notification on the import of goods to be stored in a bonded hoarding place;
- e. notification on the completion of imported goods granted import-for-re-export privileges (KITE);
- f. notification on the import of goods from a bonded hoarding place;
- g. notification on the release of goods from a bonded hoarding place with guarantee;
- h. notification on the re-entry of goods issued from a bonded hoarding place with guarantee; and
- i. notification on the release of goods to be transported from one bonded hoarding place to another.
Article 3
The import customs notifications as referred to in Article 2 can be submitted in the form of writing on the paper form or in the form of electronic data.
Article 4
(1) The import customs notifications as referred to in Article 2 shall be filled completely in Indonesian language, Latin character and Arabic numbers.
(2) The import customs notifications as referred to in paragraph (1) can be filled in English in terms of:
- a. name of place or address;
- b. name of individual or corporate body;
- c. description of the types of imported goods which have no equivalent in Indonesian language;
- d. description of the types of imported goods which have equivalent in Indonesian language but the English technical terms related to the internationally known terms need to be mentioned.
CHAPTER II
NOTIFICATION ON THE IMPORT OFGOODS
Article 5
(1) Notification on the import of goods as referred to in Article 2 letter a shall use code BC2.0.
(2) The notification form as referred to in paragraph (1) shall:
- a. use paper A4 (8.3 X 11.7 inch), letter (8.5 x 11.0 inch), legal (8.5 x 14.0 inch), or foolscap size (8.5 x 13.0 inch);
- b. consist of:
- 1. first sheet;
- 2. continued sheet for description of goods if customs notification consists of more than 1 (one) records of goods;
- 3. attachment sheet for data on containers if the customs notification consists of more than 8 (eight) containers; and
- 4. attachment sheet for customs supplement if the first sheet cannot accommodate all customs supplements.
- c. be made in 3 (three) copies as follows:
- 1. first sheet for the customs office;
- 2. second sheet for the Central Statistics Board (BPS);
- 3. third sheet for Bank Indonesia (BI).
Article 6
The model and content of notification/on the import of goods and guide to fill it shall follow attachment I which is an integral part of this Regulation of the Director General.
CHAPTER III
NOTIFICATION ONTHE IMPORT OF SPECIAL GOODS
Article 7
(1) Notification on the import of special goods as referred to in Article 2 letter b shall use code BC 2.1.
(2) The notification form as referred to in paragraph (1) shall:
- a. use paper A4 (8.3 X 11.7 inch), letter (8.5 x 11.0 inch), legal (8.5 x 14.0 inch), or foolscap-size (8.5 x 13.0 inch); and
- b. consist of:
- 1. first sheet;
- 2. continued sheet for description of goods if customs notification consists of more than 1 (one) records of goods; and
- 3. attachment sheet for parcels sent through a forwarding agent.
- c. be made in 3 (three) copies as follows:
- 1. first sheet for the customs office;
- 2. second sheet for the Central Statistics Board (BPS);
- 3. third sheet for Bank Indonesia (BI).
Article 8
The model and content of notification on the import of special goods and guide to fill it shall follow attachment II which is an integral part of this Regulation of the Director General.
CHAPTER IV
NOTIFICATION ON THE PERSONEL ARTICLES OF PASSENGERS AND CREW MEMBERS OF TRANSPORT MEANS (CUSTOMSDECLARATION)
Article 9
(1) Notification on the personal articles of passengers and crew members of transport means as referred to in Article 2 letter c shall use code BC 2.2.
(2) The notification form as referred to in paragraph (1):
- a. shall use paper measuring 260 x 180 mm;
- b. shall consist of 1 (one) notification sheet; and
- c. shall be made in 1 (one) copy for the customs office.
(3) In addition to using Indonesian language, the notification form as referred to in paragraph (1) can use translation in English, Japanese, French, German, Arabic and Chinese.
Article 10
The model and content of notification on the personal articles of passengers and crew members of transport means (customs declaration) and guide to fill it shall follow attachment III which is an integral part of this Regulation of the Director General.
CHAPTER V
NOTIFICATION ON THE IMPQRT OF GOODS TO BE STORED IN BONDED PILING PLACE
Article 11
(1) Notification on the import of goods to be stored in a bonded hoarding place as referred to in Article 2 letter d shall use code BC 2.3.
(2) Notification form as referred to in paragraph (1) shall:
- a. use paper A4 (8.3 X 11.7 inch)[ letter (8.5 x 11.0 inch), legal (8.5 x 14.0 inch), or foolscap size (8.5 x 13.0 inch);
- b. consist of:
- 1. first sheet;
- 2. continued sheet, if the customs notification consists of more than 1 (one) records of goods;
- 3. attachment sheet I, if the customs notification consists of more than 10 (ten) containers; and
- 4. attachment sheet II, if the first sheet cannot accommodate all customs supplements.
- 5. attachment sheet III, which constitutes attachment to record on verification of goods in case of verification of goods; and
- 6. attachment sheet IV, which constitutes attachment to a summary of physical audit in case of physical audit.
- c. be made in 5 (five) copies:
- 1. first sheet for the customs office overseeing the bonded hoarding place;
- 2. second sheet for the bonded hoarding place importing goods;
- 3. third sheet for the customs office where goods are unloaded;
- 4. fourth sheet for the Central Statistics Board (BPS); and
- 5. fifth sheet for Bank Indonesia (BI).
Article 12
The model and content of notification on the import of goods to be stored in the bonded hoarding place and guide to fill it shall follow attachment IV which is an integral part of this Regulation of the Director General.
CHAPTER VI
NOTIFICATION ON THE COMPLETION OF IMPORTED GOODS GRANTED IMPORT FOR RE-EXPORT FACILITY(KITE)
Article 13
(1) Notification on the completion of imported goods granted KITE as referred to in Article 2 letter e shall use code BC2.4.
(2) The notification form as referred to in paragraph (1) shall:
- a. use paper A4 (8.3 X 11.7 inch), letter (8.5 x 11.0 inch), legal (8.5:< 14.0 inch), or foolscap-size (8.5 x 13.0 inch);
- b. consist of:
- 1. first sheet;
- 2. continued sheet, if the customs notification consists of more than 1 (one) records of goods;
- 3. attachment sheet I, for data on the use of imported goods and/or materials, containing data on the use of imported goods and/or materials as well as the number and date of the import notification (PIB). This attachment sheet must always be attached to the document on the use of imported goods and/or materials for completion;
- 4. attachment sheet Il, for data on the realization of export and delivery to the bonded zone, containing data on the realization of export and delivery to the bonded zone to be used for:
- a. calculation for domestic sales of products in good condition; and
- b. supporting data in the domestic sales of damaged products, by-products, product leftover and damaged raw materials.
- c. be made in 3 (three) copies:
- 1. first sheet for the customs office;
- 2. second sheet for the regional office;
- 3. third sheet for the notifier.
Article 14
The model and content of notification on the completion of imported goods granted KITE and guide to fill it shall follow attachment V which is an integral part of this Regulation of the Director General.
CHAPTER VII
NOTIACATION ONTHE IMPORT OF GOODS FROM BONDED HOARDING PLACE
Article 15
(1) Notification on the import of goods from a bonded hoarding place as referred to in Article 2 letter f shall use code BC2.5.
(2) The notification form as referred to in paragraph (1) shall:
- a. use paper A4 (8.3 X 11.7 inch), letter (8.5 x 11.0 inch), legal (8.5 x 14.0 inch), or foolscap-size (8.5 x 13.0 inch);
- b. consist of:
- 1. first sheet;
- 2. continued sheet for data on goods, if the customs notification consists of more than 1 (one) records of goods;
- 3. continued sheet for supplement to customs document, if the first sheet cannot accommodate all supplements to customs document; and
- 4. attachment sheet for data on the use of imported. goods and/or materials, used as reference for the origin of goods to be imported/completed.
- c. be made in 3 (three) copies:
- 1. first sheet for the customs office overseeing the bonded hoarding place;
- 2. second sheet for the operator of bonded hoarding place; and
- 3. third sheet for the recipient of goods.
Article 16
The model and content of notification on the import of goods from a bonded hoarding place and guide to fill it shall follow attachment VI which is an integral part of this Regulation of the Director General.
CHAPTER VIII
NOTIFICATION ON THE RELEASE OF GOODS FROM BONDED HOARDING PLACE WITH GUARANTEE
Article 17
(1) Notification on the release of goods from a bonded hoarding place with guarantee as referred to in Article 2 letter g shall follow code BC 2.6.1.
(2) The notification form as referred to in paragraph (1) shall:
- a. use paper A4 (8.3 X 11.7 inch), letter (8.5 x 11.0 inch), legal (8.5 x 14.0 inch), or foolscap-size (8.5 x 13.0 inch);
- b. consist of:
- 1. first sheet;
- 2. continued sheet for data on goods, if the customs notification consists of more than 1 (one) records of goods;
- 3. continued sheet for supplement to customs document, if the first sheet cannot accommodate all supplements to customs document; and
- 4. attachment sheet for the re-entry of goods to the bonded hoarding place; and
- 5. attachment sheet for the conversion of materials used (subcontract), if the release of goods is intended for subcontract.
- c. be made in 3 (three) copies:
- 1. first sheet for the customs office overseeing the bonded hoarding place;
- 2. second sheet for the operator of bonded hoarding place; and
- 3. third sheet for the recipient of goods.
Article 18
The model and content of notification on the release of goods from a bonded hoarding place with guarantee and guide to fill it shall follow attachment VII which is an integral part of this Regulation of the Director General.
CHAPTER IX
NOTIFICATION ON THE RE-ENTRY OF GOODS RELEASED FROM A BONDED HOARDING PLACE WITH GUARANTEE
Article 19
(1) Notification on the re-entry of goods released from a bonded hoarding place with guarantee as referred to in Article 2 letter h shall use code BC 2.6.2.
(2) The notification form as referred to in paragraph (1) shall:
- a. use paper A4 (8.3 X 11.7 inch), letter (8.5 x 11.0 inch), legal (8.5 x 14.0 inch), or foolscap-size (8.5 x 13.0 inch);
- b. consist of:
- 1. first sheet;
- 2. continued sheet for data on goods, if the customs notification consists of more than 1 (one) records of goods; and
- 3. continued sheet for supplement to customs document, if the first sheet cannot accommodate all supplements to customs document.
- c. be made in 3 (three) copies:
- 1. first sheet for the customs office overseeing the bonded hoarding place;
- 2. second sheet for the operator of bonded hoarding place; and
- 3. third sheet for the sender of goods.
Article 20
The model and content of notification on the re-entry of goods released from a bonded hoarding place with guarantee and guide to fill it shall follow attachment VIII which is an integral part of this Regulation of the Director General.
CHAPTER X
NOTIFICATION ON THE RELEASE OF GOODS TO BE TRANSPORTED FROM ONE BONDED HOARDING PLACE TO ANOTHER
Article 21
(1) Notification on the release of goods to be transported from one bonded hoarding place to another as referred to in Article 2 letter i shall use BC 2.7.
(2) The notification form as referred to in paragraph (1) shall:
- a. use paper A4 (8.3 X 11.7 inch), letter (8.5 x 11.0 inch), legal (8.5 x 14.0 inch), or foolscap-size (8.5 x 13.0 inch);
- b. consist of:
- 1. first sheet;
- 2. continued sheet for data on goods, if the customs notification consists of more than 1 (one) records of goods;
- 3. continued sheet for supplement to customs document, if the first sheet cannot accommodate all supplements to customs document; and
- 4. attachment sheet for the conversion of materials used (subcontract), if the release of goods is intended for subcontract.
- c. be made in 4 (four) copies:
- 1. first sheet for the customs office overseeing the bonded hoarding place of origin;
- 2. second sheet for the operator of sending bonded hoarding place;
- 3. third sheet for the customs office overseeing the bonded hoarding place receiving goods; and
- 4. fourth sheet for the operator of receiving bonded hoarding place.
Article 22
The model and content of notification on the release of goods to be transported from one bonded hoarding place to another and guide to fill it shall follow attachment IXI which is an integral part of this Regulation of the Director General.
CHAPTER XI
TRANSITIONAL PROVISIONS
Article 23
(1) Notification on the import of goods (BC 2.0) as contained in attachment X which is an integral part of this Regulation of Director General shall:
- a. at the customs offices that have not yet used a computerized service system, be made retroactive to December 26, 2008 until this Regulation of the Director General comes into force.
- b. at the customs offices that have used a computerized service system, be made retroactive to December 26, 2008 until no later than the date set in attachment XVI which is an integral part of this Regulation of the Director General.
(2) Import notification in the form of:
- a. notification on the import of certain goods (BC 2.1) as contained in attachment XI which is an integral part of this Regulation of the Director General;
- b. notification on the goods of passengers or crew members of transport means (BC 2.2) as contained in attachment XII which is an integral part of this Regulation of the Director General;
- c. notification on the entry of imported goods to a bonded hoarding place (BC 2.3) as contained in attachment XIII which is an integral part of this Regulation of the Director General;
- d. notification on the completion of imported goods exempted from import duty and/or excise as well as value added tax (PPN) and sales tax on luxury goods (PPnBM)(BC 2.4) as contained in attachment XIV which is an integral part of this Regulation the Director General;
- e. notification on the transport of imported/export goods from one place to another under customs surveillance (BC 2.3) as contained in attachment XV which is an integral part of this Regulation of the Director General; shall be made retroactive to December 26, 2008 until this Regulation of the Director General comes into force.
Article 24
When this Regulation of the Director General begins to take effect,
- 1. notification on the transport of imported/export goods from one place to another under customs surveillance (BC 2.3) as referred to in Article 23 paragraph (2) letter e shall be stipulated as follows:
- a. for the release of goods from a bonded hoarding place to other place in a customs area where the obligation to give guarantee prevails, it is replaced with notification on the .release of goods from a bonded hoarding place with guarantee (BC 2.6.1) as laid down in this Regulation of the Director General;
- b. for the re-entry of goods released from a bonded hoarding place to other place in a customs area where the obligation to give guarantee prevails, it is replaced with notification on the re-entry of goods released from a bonded hoarding place with guarantee (BC 2.6.2) as laid down in this Regulation of the Director Genera!;
- c. for the release of goods from one bonded hoarding of place to another it is replaced with notification on the release of goods to be transported from one bonded hoarding place to another (BC 2.7) as laid down in this Regulation of the Director General.
- 2. for the release of goods from bonded hoarding places which have so far been conducted by submitting an import notification (BC 2.0) as referred to in Article 23 paragraph (1), it is replaced with notification on the import of goods from a bonded hoarding place (BC 2.5) as laid down in this Regulation of the Director General.
CHAPTER XII
CONCLUSION
Article 25
This regulation of the Director General shall come into force 60 (sixty) days after the date of stipulation.
